What Are Contingency Fees?

Some people who suffer serious injuries in accidents put off talking to an attorney because they think they can't afford it. In reality, most personal injury lawyers charge nothing up front. Instead, they provide legal services under what is known as a contingency fee arrangement.

This means that attorney fees are contingent upon recovering compensation for the client. If the attorney is unable to recover compensation for the client, the client would not owe the attorney any money. However, you should ask your attorney if you will be responsible for court-filing fees or any other expenses associated with your case.

The contingency fee is a percentage of the recovery for personal injury, which includes such losses as medical bills, lost wages, and pain and suffering. Attorneys typically invest money in a case to collect and preserve evidence, take depositions, and hire experts. Those expenses will be subtracted from the case settlement or verdict before the contingency fee is applied.

An insurance company would have no reason to make a fair settlement offer to an injured person if it knew the individual could not afford to hire an attorney.

The contingency fee arrangement makes your interests and the interests of your attorney the same. Your attorney will seek the maximum compensation for your losses, since he or she will earn a percentage of it. Injured plaintiffs typically recover more compensation when they hire an attorney, even after paying contingency fees, than they could recover by negotiating with the insurance company themselves.
