What car accident victims should not say to an insurance adjuster

People who are injured in car accidents often receive calls from adjusters working for the other driver's insurance company. The adjuster may ask the accident victim to make a recorded statement.

Speaking to an insurance adjuster is always risky. Here are some examples of statements that can cost accident victims money when it comes time to resolve their personal injury claim.

  • I feel fine. Most people don't like to complain about minor aches and pains. However, those aches and pain can get worse in the days and weeks after an accident. Do not say anything until you are sure you are all right.
  • I may have been going a few miles over the speed limit. Even if the other driver was clearly at fault, admitting negligence can result some of the fault being assigned to you. In North Carolina, your claim will be reduced by any percentage of fault the insurance company can pin on you.
  • Sure, I'll explain one more time how it happened. The insurance adjuster may ask you to explain what happened over and over. If you vary in any detail, the insurance company may accused you of changing your story or lying.
