Should I accept a car accident settlement offer?

A person injured in a car accident may receive a settlement offer from an adjuster working for the insurance company of the other driver. To the injured person, it may seem like a quick and easy to resolve their case.

Accepting a settlement can have a high cost, however. Once you accept a settlement, your case is over. You can't go back to the insurance company later and ask for more money if damages are greater than you first thought.

Is the offer fair?

The insurance company representing the driver who injured you has only one reason for offering you a settlement now. It wants to avoid paying you more money later. The damages in your case, including past and future medical bills, past and future lost wages, and pain and suffering, may be far higher than the insurance company is offering you.

Most people simply don't know how much their personal injury case is worth. This puts you at a disadvantage, since the insurance company does know.

Why you should wait before accepting a settlement

Accepting a settlement before you have fully recovered from your injuries is one of the biggest mistakes you can make. Until you recover, you won't know:

  • What your future medical bills will be
  • Whether you might need future surgery
  • Whether you will have physical limitations as the result of your injury
  • Will you will have pain from the injury that affects your quality of life

If you recover fully from your injuries in a few weeks or months, that is the best outcome you can hope for. But in case you don't recover fully, it is important not to settle your case until you know.
