1 dies, another injured in wreck in northeast Raleigh

CBS affiliate WNCN reports that as a result of a head-on collision on Tuesday, Jan. 10, in northeast Raleigh, one driver died and another suffered serious injuries.

According to an accident report by the Raleigh Police Department, a 44-year-old Raleigh man was killed when for unknown reasons, his 1997 Toyota crossed the center line as he was northbound on New Hope Road. He then collided with a woman heading south in a 2009 Nissan.

Authorities report that the fatal wreck occurred shortly after 8 p.m., where North New Hope intersects with Marsh Creek Road. It is estimated that both vehicles were being driven at speeds of 50 miles per hour at the time of the accident.

The male driver was pronounced deceased at the scene of the collision. The woman driving the Nissan, a 34-year-old Raleigh resident, suffered serious injuries and was taken for treatment at WakeMed.

After the collision, police shut down highway for several hours to investigate the circumstances surrounding the fatal wreck.

No mention was made of any suspected impairment on the part of either driver.

When a fatal accident claims the life of someone whom you love, like a spouse or close relative, it may be possible to pursue legal claims against the other driver if he or she was at fault in the collision.

However, because North Carolina laws dealing with negligence are based on contributory negligence doctrines, if plaintiffs are found to even be partially at fault for the accident, they can't recover even a fraction of damages. Most states have comparative negligence laws on their books, which permit financial recover for a portion of the damages that are not deemed to be the plaintiff's fault.

As this can be a fine legal distinction, it's a good idea to consult with a North Carolina personal injury attorney if you were injured in an auto accident.
